DECISION BY THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

ON ESTABLISHMENT OF THE CAU SUB-RBO UNDER THE RRBO

MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Law on Water Resources Coded 08/1998/QH10 approved by the National Assembly of Viet Nam on May 20, 1998;

Pursuant to the Government Decree No. 86/2003/ND-CP on July 18, 2003 on mandates, responsibilities, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government Decree 179/1999/ND-CP dated December 30, 1999 regulating the implementation of the Law on Water Resources;

Considering the request of Chairpersons of Provincial People’s Committee of Bac Kan, Thai Nguyen, Vinh Phuc, Bac Giang, Bac Ninh provinces and the People’s Committee of Hanoi city on the establishment of Cau Sub-RBO;

Considering the request of the Chair of the RRBO, Director of the Department of Water Resources and the Department of Organization and Personnel;

HEREBY DECIDES

Article 1.  To establish the Cau Sub-RBO under the RRBO to assist the Chair of the RRBO in implementing the tasks assigned by the Minister of Agriculture and Rural Development.

Article 2. The Cau Sub-RBO comprises of following members:

-          Chairman: A Chairperson of one of the member provinces in the Cau Sub basin (including Bac Kan, Thai Nguyen, Vinh Phuc, Bac Giang, Bac Ninh provinces and Hanoi city) in a 2 year mandate

-          Vice Chairman:

o        The standing Vice Chairman is Director of the Department of Agriculture and Rural Development of Thai Nguyen province

o        Other Vice Chairmen are Directors of the provincial Departments of Agriculture and Rural Development of the member provinces

-          Members:

o        Permanent members are representatives of the RRBO; leaders of provincial departments of Agriculture and Rural Development, Science and Technology, Natural Resources and Environment, Health, Planning and Investment, Army Headquarter, Branches of Water Resources, Dike Management and Flood Control in the member provinces.

o        Non-permanent members are representatives of related provincial organizations, District People’s committees of towns and districts in the basin, and organizations and individuals invited by the Sub-RBO Chairperson in resolving relevant issues.

Article 3.  The Cau Sub-RBO has its Office based at Thai Nguyen provincial Department of Agriculture and Rural Development. The Cau sub-RBO Office is headed by the Standing Vice Chair of the sub-RBO.

Directors of the provincial branches of Water Resources of the member provinces are Deputy Head of the Sub-RBO Office.

            The Office of the Cau-Sub RBO is authorized to use its own stamp and account in conformity with prevailing regulations.

Permanent staffs of the Office of the Cau Sub-RBO are included in numbers of permanent staffs of the provincial Departments of Agriculture and Rural Development of the member provinces.

The operation budget of the Cau-Sub RBO is from the contribution of provincial People’s Committees of the member provinces, from the financial support of the Ministry of Agriculture and Rural Development, and from donors (if available) through the Office of the RRBO.

Article 4: This decision shall come into effect 15 Caus upon signature. The Chairperson of the RRBO has responsibility to prepare and issue the Statute on Organization and Operation of the Cau sub-RBO upon the effectiveness of the present decision.

Article 5:   

Head of the Ministerial Office, Directors of Departments of Organization and Personnel, Water Resources and Dike Management and Flood Control, Director of the Institute of Water Resources Planning, Directors of provincial Departments of Agriculture and Rural Development of Bac Kan, Thai Nguyen, Vinh Phuc, Bac Giang, Bac Ninh provinces and Hanoi city and leaders of related ministerial departments shall have responsibility to enforce this decision./.
